The Volvo Group may process personal data about you, if you are an individual who has been recorded or detected by cameras, optical-electronic instruments, equipment that is able to record audio and other similar equipment (“Camera Equipment”) installed in a Volvo Group branded vehicle and where recordings and detections have been made of a vehicle’s surroundings

VOLVO will process the following categories of personal data. Please note that VOLVO will not necessarily process all the data listed below. 

- Camera Equipment recordings of a vehicle’s surroundings (vehicle registration numbers or individuals, faces, distinctive clothing, specific body movements, specific anatomy, other elements which may be used to identify a natural person).

- Camera Equipment material in real time (no recordings are made and stored) of a vehicle’s surroundings. 

Legal basis and purposes of the processing

R&D and solving quality issues

VOLVO processes your personal data for research and development purposes (including but not limited to the development of automatic functions in vehicles), such as to analyze the behavior and functions of vehicles and other Volvo Group products and the behaviors of drivers in order to use the information to further develop and make improvements from a safety, efficiency, environmental and ergonomics perspective. 

Volvo also processes your personal data in order to prevent, identify and solve quality issues related to VOLVO Group products and services. 

The processing set out above is based on VOLVO’s legitimate interest (to provide safe and more customized products of good quality to its customers).

Defend and establish legal claims

VOLVO uses personal data only to the extent it is relevant in each specific case in order to defend and/or establish legal claims. This processing is based on VOLVO’s legitimate interest (to defend and maintain VOLVO’s assets and property as well as defend VOLVO from any third party claims).

VOLVO processes personal data that we have collected from you by using Camera Equipment that is mounted onto specific research trucks. The personal data may therefore be obtained by VOLVO when a vehicle owned by you, or, you as a driver of a vehicle, passenger or pedestrian, pass or get passed by a research truck that uses Camera Equipment. 

VOLVO will normally not share your personal data with anyone outside of the Volvo Group, unless required by law or regulation. However, VOLVO may, if necessary to fulfil the purpose for processing the personal data, share your personal data with other Volvo Group company, including company outside of the European Union or the European Economic Area EU/EEA. VOLVO may also, if necessary to fulfil the purpose for processing the personal data, share your personal data with third party suppliers and agents, including suppliers and agents outside of EU/EEA.

VOLVO will secure that appropriate safeguards in place which provide adequate levels of protection of your personal data as required by applicable data protection laws. For example, this may include the use of intercompany or external data processing agreements based on EU approved Standard Contractual Clauses or EU-US Privacy Shield or such other mechanisms as have been recognized or approved by the relevant authorities from time to time. If VOLVO is not able to either automatically or manually anonymize (blur) or delete your personal data in connection with the creation of the recordings, the personal data will be kept by VOLVO in accordance with the following retention periods.

VOLVO will not keep personal data detected by Camera Equipment in real time since no recordings are made.

VOLVO will keep personal data contained in recordings for as long as it is necessary in order to fulfil the purpose for the processing.

VOLVO will use personal data for the time necessary in order to defend and/or establish legal claims or for a maximum of 10 years after a claim has been addressed or at the latest 10 years after a claim otherwise has been finally settled by agreement, by competent authority or in a court of law.

You have the right to request from VOLVO information about the personal data processed about VOLVO and access to such personal data. You also have a right to request rectification of your personal data if this is incorrect and request erasure of your personal data. Further, you have a right to request restriction of the processing of your personal data meaning that you request VOLVO to limit its processing of your personal data under certain circumstances. There is also a right for you to object to the processing based on legitimate interest or processing for direct marketing. You have as well the right to data portability (transfer of your personal data to another controller) if VOLVO’s processing of your personal data is based on consent or contractual obligation and is automated.

You also have the right to lodge any complaints you may have regarding VOLVO’s processing of your personal data to a supervisory authority. For more information about these rights and how to exercise them, please contact the VOLVO Group Privacy Officer.
